Oklahoma Oversize and Overweight Fines and Penalties

All size and weight limits imposed by Oklahoma law are subject to the limitations of 23 U.S.C. 127 (imposing weight limitations on interstate travel of 20,000 pounds per single axle, 34,000 pounds per tandem axle and gross weight determined by formula, but not to exceed 80,000 pounds (except for designated routes or vehicles with special permits under state law)). The following size and weight limitations have been adopted by the State of Oklahoma. In addition, local authorities may set size or weight limitations for highways under their jurisdiction. These limitations are to be indicated by the posting of signs on the applicable highways. Any person that drives, moves or causes to be moved upon any highway any vehicle or vehicles that violates the size and weight limitations imposed by Oklahoma law is guilty of a misdemeanor. Violation of the size limitations carries a fine between $5 - $500 or by imprisonment for up to ten days. Successive size violations within one year of prior convictions increase potential jail time to up to twenty days for a second violation, or up to six months for a third or subsequent violation, or by both imprisonment and fine. Any person that knowing or willfully violates the weight limitations imposed by law or permit is guilty of a misdemeanor. Upon conviction in a criminal court, such a misdemeanor is punishable by a fine of up to $1,000. In addition, any person committing such a violation is in contempt of the Corporation Commission and is subject to a fine of up to $500.
