Simplify Your Oversize/Overweight Loads
For each violation of an operational or safety stipulation in a special permit, the penalty shall be an amount not to exceed one thousand dollars ($1,000) per violation and penalties for multiple violations of operational or safety stipulations shall be cumulative except that the total penalty for the vehicle shall not exceed one thousand dollars ($1,000). For weight violations, a penalty as provided in s. 316.545 shall be assessed for those weights which exceed the limits thus established for the vehicle; and for dimensional, operational, or safety violations, a penalty as established in paragraph (c) or s. 316.516, whichever is applicable, shall be assessed for each nonconforming dimensional, operational, or safety violation and the penalties for multiple violations shall be cumulative for the vehicle. A person who violates the overloading provisions of this chapter is conclusively presumed to have damaged the highways of this state by reason of such overloading, and a fine shall be assessed as follows:
1. Ten dollars ($10) if the weight in excess of the maximum allowed under this chapter is two hundred pounds (200 lbs) or less.
2. Five cents per pound ($.05) for each pound of weight in excess of the maximum provided in this chapter if the excess weight is greater than two hundred pounds (200 lbs).
3. If the gross weight of the vehicle or combination of vehicles does not exceed the maximum allowable gross weight, the maximum fine for the first six hundred pounds (600 lbs) of unlawful axle weight is ten dollars ($10).
